Welcome to 123Hits.Surf (the “Website”). The Website is an online traffic exchange platform that allows members to view other members’ websites and advertisements, including banner and text advertisements, in exchange for credits that can be used to promote their own websites and advertisements.
The Website is operated by 123hits.surf (“we”, “us” or “our”), whose principal place of business is in Scotland, United Kingdom. These Terms govern your access to and use of the Website, associated services, and materials made available through it (together, the “Service”).
1. Definitions
- Account means a registered user account on the Website.
- Member or you means any person or entity registered for an Account or otherwise using the Service.
- Credits means non-monetary units used within the Service and earned through surfing, purchases, or rewards.
- Traffic Exchange means the system through which Members view websites or advertisements to earn Credits.
- Content means any text, images, graphics, code, links, websites, or other material submitted through the Service.
- Advertisements means banner ads, text ads, and other promotional materials submitted to the Service.
2. Acceptance, eligibility, and authority
- You must be at least 18 years old and legally capable of entering into a binding contract to use the Service.
- If you use the Service for a business or legal entity, you warrant that you have authority to bind that entity to these Terms.
- You are responsible for ensuring that your use of the Service is legal in your own jurisdiction.
3. Account registration and security
- You must provide accurate, current, and complete registration information, including a valid email address, and keep it updated.
- You are responsible for protecting your username and password and for all activity occurring through your Account.
- You must not share access to your Account and must notify us immediately of suspected unauthorised access or a security breach.
- Unless we give written permission, only one Account is permitted per person. Duplicate or related Accounts may be suspended or terminated.
4. Description and availability of the Service
The Service may include a traffic exchange, banner and text advertising, upgraded membership levels, referral features, games, prizes, and promotional systems. Members may earn Credits or impressions by viewing websites for a specified period and may assign those balances to eligible promotions.
We may modify, suspend, replace, or discontinue part of the Service at any time, provided that we do not unlawfully remove rights already acquired under applicable law.
5. Surfing, Credits, and advertising
- Surf timers, earning ratios, allowances, and benefits may vary by membership level and may change.
- Credits, impressions, and virtual items are internal features only. They are not legal tender, have no cash value, and may not be redeemed for money.
- Balances may be used to assign traffic or impressions to eligible websites and advertisements or to access internal promotions.
- Virtual balances are non-transferable unless expressly permitted by the Service and do not constitute property.
- We may correct or reverse balances resulting from error, technical failure, fraud, abuse, a reversed transaction, or breach of these Terms.
6. Referral programme
The Service may allow Members to earn Credits, commissions, or other rewards for referrals. Referral links must not be promoted through spam, unsolicited messages, unlawful conduct, deception, or unethical marketing. We may reverse or withhold rewards connected to fraudulent, misleading, or abusive referrals.
7. Member responsibilities
You must use the Service lawfully, comply with these Terms, and ensure that all Content you submit complies with applicable laws and third-party rules. You remain solely responsible for your Content and the consequences of displaying or promoting it.
8. Prohibited content
You must not submit, promote, or display Content that:
- is unlawful or promotes violence, terrorism, criminal activity, illegal drugs, or unlawful weapons;
- is pornographic, sexually explicit, unlawfully age-restricted, or exploits minors in any manner;
- is hateful, harassing, defamatory, discriminatory, or incites hatred or discrimination;
- infringes intellectual property, privacy, or other third-party rights;
- contains malware, viruses, spyware, malicious scripts, forced downloads, or harmful code;
- is fraudulent, deceptive, or misleading, including false income claims, pyramid schemes, or Ponzi schemes; or
- cannot lawfully be promoted in Scotland, the UK, or the Member’s jurisdiction.
9. Prohibited practices
- No bots, scripts, autosurfs, automated systems, or third-party services may simulate traffic, views, or clicks.
- You must not bypass timers, captchas, security controls, or anti-fraud systems.
- You must not disrupt the Service, gain unauthorised access, use false identities, manipulate statistics, or abuse promotions.
- You must not sell, trade, or transfer Accounts or Credits unless we expressly permit it in writing.
- You must not exchange clicks or sign-ups in breach of another website’s, affiliate programme’s, or advertising network’s terms.
10. Advertising standards
Submitted sites and advertisements must load correctly in current browsers and must not use harmful frame-breaking, forced downloads, excessive pop-ups, browser hijacking, phishing, fake alerts, fake login pages, or techniques that prevent a visitor from leaving. We may review, reject, pause, or remove any promotion that we reasonably believe breaches these Terms or risks harm to Members, the Service, or our reputation.
11. Memberships, purchases, and payments
- Paid memberships and delivered Credits or impressions are generally non-refundable except where required by law or expressly stated otherwise.
- Prices, benefits, and membership features may change. We will use reasonable efforts to notify paid Members of material changes affecting them.
- You are responsible for applicable taxes and local charges relating to purchases or income.
- You should contact us before starting a chargeback or payment dispute. Fraudulent or abusive chargebacks may result in suspension or termination.
12. No guarantee of results
We do not guarantee any number of visitors, clicks, sign-ups, sales, earnings, conversions, or other result. Examples of performance or earnings are illustrative only and are not promises. Traffic may not meet your expectations or produce profit.
13. Intellectual property
The Website, Service, software, design, logos, trademarks, and content created by or for us are owned by or licensed to us. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service in accordance with these Terms. You may not copy, modify, sell, lease, distribute, or create derivative works from the Service without written permission.
You retain ownership of Content you submit. By submitting Content, you grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, and distribute that Content for the operation and promotion of the Service. You warrant that you hold all rights necessary to submit it.

The Service displays websites and Content controlled by Members and third parties. We do not control or endorse them and are not responsible for their content, products, offers, security, or conduct. You visit and interact with third-party services at your own risk.
15. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim express, implied, and statutory warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will always be uninterrupted, secure, error-free, or corrected within a particular period.
16. Limitation of liability
Nothing in these Terms excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or another liability that cannot lawfully be excluded under Scottish or UK law.
Subject to the above and to the fullest extent permitted by law, we are not liable for loss of profit, revenue, business, anticipated savings, data, goodwill, reputation, or any indirect, consequential, or special damage arising from the Service. Our total aggregate liability is limited to the greater of the amount you paid us during the 12 months before the event giving rise to the claim or £50.
17. Indemnity
You agree to indemnify, defend, and hold us harmless against claims, liabilities, losses, damages, and reasonable legal expenses connected with your use of the Service, breach of these Terms, violation of law or third-party rights, or Content you submit or promote.
18. Suspension and termination
We may suspend or terminate an Account where we reasonably believe these Terms have been breached, use of the Service poses a risk, or action is required by law. On termination, access will cease; Credits, impressions, and virtual items may be forfeited; and associated Content may be removed, subject to legal retention duties. You may request closure of your Account, but closure does not create a right to a refund unless required by law.
19. Changes to these Terms
We may revise these Terms and will publish the updated version and effective date on this page. We will use reasonable efforts to give notice of material changes. Continued use after publication constitutes acceptance; if you disagree, you must stop using the Service.
20. Governing law and general provisions
These Terms and related disputes are governed by the laws of Scotland. Subject to mandatory consumer protections, the Scottish courts have exclusive jurisdiction. If a provision is invalid or unenforceable, it will be modified only as necessary and the remaining provisions will continue in effect. Failure to enforce a right is not a waiver. You may not assign your obligations without our written consent.
